Our client, Mrs Birch, suffered serious knee injuries after a skiing accident on a First Choice holiday.
Mrs Birch went on a week long holiday that included all equipment hire and adult ski school lessons.
She had been skiing on a number of previous occasions, so was placed in the intermediate group, which she felt was a suitable group.
On the fifth day of skiing lessons, the instructor took Mrs Birch and the group to a location which offered only two black runs, both of maximum difficulty. One of the runs was mogulled and this was the run that Mrs Birch was told to descend, despite having never attempted a black mogulled run before and receiving no instructions from her instructor.
Mrs Birch attempted the run but lack of experience and instruction meant that she fell on a couple of occasions. On her second fall she seriously injured her left knee.
She received treatment in the resort and intensive physio once she returned home, but she still had to have an operation to reconstruct her anterior cruciate ligament, followed by further intense physiotherapy.
We helped Mrs Birch bring a claim against the tour operator, First Choice. They denied liability but just before the trial we were able to negotiate a settlement of £15,000 on behalf of Mrs Birch.
