A man has received £9,375 compensation after he was injured in an accident at a gym.
Our client visited the gym in February 2005. As a member, he had been given a programme of exercises to do while supervised by his personal trainer. Unfortunately, as he was performing one particular exercise, his foot came off the safety mat causing the mat to flip up and strike him on the back of the left heel.
As a result our client suffered a ruptured Achilles tendon requiring surgery.
The gym initially denied that they were at fault, but the claim was successfully settled by Helen Price of Irwin Mitchell's specialist Accidents in Public Places team, without having to go to trial.
She said, "This was a difficult case where liability was denied throughout by the gym.
"More and more accidents are occurring in gyms due to inadequate supervision by trainers or where incorrect or insufficient training is given to members on how to use the equipment correctly."
