What Are The Time Limits For Making A Claim?
The standard time limit for starting a spinal cord injury claim is three years from the date you suffered your injury.
However, there are some exceptions to this time limit, including:
- Children
Children’s spinal cord injury claims can be made at any point until they turn 21.
- International claims
If your injury happened outside of the UK, the time limit can be shorter.
- Criminal injuries
Claims made through the Criminal Injuries Compensation Authority have a two year time limit.
- Mental capacity
If the injured person doesn’t have capacity to make a claim themselves (for example due to a brain injury or pre-existing learning disability) then there’s no time limit.
It’s really important that you start your claim as soon as you’re able. Apart from the time limits, it’s easier to gather evidence in support of your claim (for example from witnesses while their memory is still relatively fresh).
Starting a claim sooner may mean that you’re able to access early compensation payments. We also work with you on rehabilitation from the word go, so it’s helpful to start this process as early as possible.

How Long Will Your Claim Take?
Spinal cord injury claims usually take a few years to settle. This is because it can take a while to understand how you want to live your life in the long term. We wait until your rehabilitation is at an end, so we can properly value what you will need for the rest of your life.
It’s important that we take the time to understand the impact of your injury. Your compensation is there to provide for you for the rest of your life. Settling too early could mean that your claim is undervalued.
This isn’t to say that you won’t get any compensation for a few years. In many cases we’re able to get early (interim) compensation payments while your case is going through.
Interim payments are made where the organisation you’re claiming from has admitted responsibility early on. They can be used to ease any financial pressure you’re facing. As well as this, interim payments can pay for things that help your day-to day life and rehabilitation (for example to buy a wheelchair or to pay for physiotherapy).
