Industrial deafness compensation

A man from Wigan has been awarded a five figure sum in compensation after he suffered the Industrial Disease of Noise Induced Hearing Loss.

His award was secured with help from Mark Allen of the Industrial Disease Team at the office of National Law Firm Irwin Mitchell in Sheffield.

Mr Taylor, of Wigan was awarded the sum following his industrial deafness claim against his former employer Skanska Construction.

Mr Taylor was exposed to high levels of noise from pneumatic jack hammers and heavy construction machinery without the use of ear protection.

Tinnitus legal advice

Mr Taylor as a result of the noise exposure has been left with partial deafness and a buzzing noise in both ears, a condition known as tinnitus. Mr Taylor said "When I first noticed my hearing problems and the tinnitus I did not relate it to my exposure to noise. My exposure to noise with Skanska ceased in 1974. I am publicising my claim in the hope it will alert to others in my situation of the possibility that their hearing problems could be related to noise exposure at work and the possibility of compensation."

Mark Allen said Mr Taylor was never warned or advised about the dangers of hearing loss or tinnitus when exposed to noise at work, nor was he provided with any form of ear protection. His symptoms affect his day to day life and are permanent. This claim highlights the importance of employers taking health and safety matters seriously which includes ensuring that noise exposure is kept to a minimum and that ear protection is provided.
