A family has instructed specialist international personal injury lawyers at Irwin Mitchell to investigate an outbreak of food poisoning which ruined its five-star family holiday to celebrate a mum’s 40th birthday.
Kerry and Mark Welton, from Portsmouth, took their two children away to celebrate but Kerry suffered with severe diarrhoea and vomiting when she fell ill on the fifth day of their all-inclusive break at the Pegasos World Hotel in the Turkish resort of Side.
Kerry was forced to spend more time in her room for several days during their 11-night holiday because her symptoms were so bad. Mark, 42, and the couple’s children, 13-year-old Tommy, and Elsie-Rose, 10, were forced to cancel many of their plans because of Kerry’s illness.
Kerry is still suffering from symptoms following her return to the UK.
The family has now instructed specialist International Personal Injury lawyers at Irwin Mitchell to investigate conditions at the hotel and investigate legal action against tour operator TUI UK Ltd T/A First Choice.

The family jetted off for their holiday on September 1. Kerry, who runs her own wedding decor company, developed severe stomach cramps on September 5. Two days later, on the advice of her tour rep, she visited the hotel doctor who gave her an injection and narrowly avoided being put on a drip for an hour.
Kerry then suffered from severe diarrhoea and occasional sickness until the family flew home on September 12.
Kerry, who underwent tests at her GP surgery, is still suffering from symptoms she had on holiday.
The couple told their legal team at Irwin Mitchell that they saw on occasions flies landing on food at the resort and that some of the food was also undercooked and served uncovered. They added that some of the meals were served on more than one occasion and new dishes were sometimes added to food that had been left to stand. Some of the crockery was also dirty.
Kerry said: “We were all really looking forward to our family holiday this year which was meant to be extra special as we were due to celebrate my 40th birthday which was coming up a few weeks after.
“However, within a few days of arriving we knew something was not right. I was in severe pain with stomach cramps and to then to have to spend time ill in my hotel room because of my symptoms was really upsetting. I was in tears knowing that we were unable to do all the activities we, as a family, had planned.”
