

Legal Experts Urge Manufacturers To Ensure Lessons Are Learned

Confectionery manufacturer Nestle has launched a recall of four different Kit Kat Chunky products after seven customers came forward to say they had found plastic in the bars.
The company has confirmed it is recalling the following 48-gram bars, due to the concerns and potential risks to consumers:
- Kit Kat Chunky Peanut Butter with a best before date of between September 2013 and February 2014
- Kit Kat Chunky Hazelnut with a best before date of between September to October 2013
- Kit Kat Chunky Choc Fudge with a best before date of between September to October 2013
- Kit Kat Chunky Caramel with a best before date of between June to July 2013
Other items affected by the recall are the Kit Kat Chunky Hazelnut Multipack with a best before of September to December 2013, as well as the Kit Kat Chunky Collection Giant Egg with a best before date of July 2013.
Nestle has also asked anyone with questions regarding the recall to contact it on its helpline – 0800 604604.
David Urpeth, a Partner at Irwin Mitchell with expertise in product liability claims, said: “We would urge anyone who may have bought these Nestle products in recent weeks to carefully check the dates on the products and return the items if they fall into the best before date ranges.
“While the steps Nestle have taken are to be welcomed, both the consumers affected and the general public will be keen to know not only how this plastic came to be in the products, but also what steps are being taken to prevent this issue from arising again.
“Consumers put great trust in manufacturers that the items they buy are safe for consumption and an incident like this can partially erode that faith. Sadly we have seen many cases where people have been injured or suffered illness due to safety failings in various production processes.
“We hope that lessons can be learned which will ensure that the issues seen in this case are not repeated in the future.”
