High Court Hears Of Delays In Care

The £4.5 million payout awarded to a woman who was left brain damaged after a delay in treatment has been welcomed by a medical negligence expert at Irwin Mitchell.

Action was taken against Maidstone and Tunbridge Wells NHS Trust over the care received by Frances Bowra, when she was taken to Accident and Emergency at Maidstone District General Hospital after collapsing at home.

It was revealed at the High Court that delays in diagnosis and hospital transfers led her condition to deteriorate. The problems have left Mrs Bowra partially paralysed with eyesight problems and dependent on others to provide care for her.

Auriana Griffiths, a Partner at the law firm, said: “The payout in this case demonstrates the serious impact that NHS errors have on both victims and their loved ones.

“Time and time again we deal with and see cases in the media which highlight problems in care which could have been prevented.

“While no payout would ever repair the damage done, the sum in this case will go some way to ensuring the victim and her family can guarantee she is given the care she needs for the rest of her life.”
