Inquest Records Narrative Verdict

Nurseries must place a greater focus on the safety and supervision of youngsters following the inquest into the tragic death of a two-year-old child, a lawyer at Irwin Mitchell has urged.

Two-year-old Rhiya Malin died from a cardiac arrest following compression of the neck, which was caused when she became stuck in the window of a wooden playhouse at Casterbridge Care and Education Nurseries in Chigwell in 2007.

A jury recorded a narrative verdict in relation to the death and the parents of the youngster have since confirmed their intention to take legal action against the nursery over the incident.

Commenting on the case, Keith Barrett, who specialises in public liability cases for Irwin Mitchell, said: “Reports have revealed how the inquest highlighted concerns over the supervision of children at the site, as well as the quality of health and safety training offered to members of staff.

“It is clear that lessons need to be learnt from this tragic accident, with all nurseries doing their upmost to recognise the importance of having full and proper safety guidance in place.

“Health and safety must always be a priority for those taking care of children, whether that means carrying out checks on play equipment or generally keeping an eye on the youngsters’ movements.”
