Irwin Mitchell acted for K, a 17 year old, who was travelling in a vehicle when the driver lost control and collided with a tree. K sustained fractures to his left arm, shoulder and both legs. He was taken to Leeds General Infirmary where K underwent several surgical procedures and remained in hospital for approximately one month.
Following discharge from hospital, K struggled to walk and a bed was set up for him on the ground floor of his house so that he would not have to climb the stairs. During his recovery period K required assistance from his family members with all aspects of his personal care as well as assistance around the house.
With the help of Cathryn Godfrey of the Leeds Serious Injury team, K brought a claim against the driver of the vehicle and received £20,000.00 from the driver’s insurance company in settlement of his claim.
Cathryn said, “At the time of the accident, K had limitations to his mobility due to an underlying medical condition. The injuries sustained in the accident compounded these and made life more restricted for K during his recovery. Fortunately, on this occasion, K made a full recovery from the injuries sustained and they have not made his underlying condition worse or affected his prognosis in the future.
“The money received is compensation for the injuries sustained and also includes compensation for the losses and expenses incurred as a consequence of the accident. This includes the care and assistance received as a consequence of the injuries sustained, over and above that which K required in any event”.
