Services in: Fall From Height Claims

    • Ladder Fall Compensation Claims

Working at height is particularly dangerous and employers should take extra care to reduce the risks and the consequences of an employee falling.

When this protection is not in place and a worker falls, they can be left with serious injuries or even killed – the Health and Safety Executive estimates that around 50 people die every year because of falls from height. Certain types of worker are more at risk of a fall from height, such as those that frequently use:

  • Ladders
  • Scaffolding
  • Cherry pickers or cranes

If you or a loved one have been injured by a fall from height, our solicitors could help you claim compensation.

Employers should consider whether certain tasks could be carried out from ground level if the right equipment is provided. If there is no alternative to working from height, protective measures should be in place to reduce the risk of serious injury.

We’ll investigate whether your employer failed to meet their obligations to keep you safe at work, consulting independent health and safety experts for their opinion on your case.

Our experience in work accident claims means we understand how your life will be affected by your injuries and what positive action we can take to help you with your claim and ongoing care.

We’ve represented thousands of people in workplace accident claims over the years, so we know exactly how to secure the compensation you deserve.

Most of the claims we handle are on a No Win No Fee basis, which means that you won’t have to pay any legal fees if your claim isn’t successful*.

Fall from height claims - more information

Falling from height has the ability to cause a multitude of different injury types. Each fall can be different so we need to make sure the level of compensation is tailored to your specific needs and the injury you sustained.

Injuries caused by a fall from height while working can range from:

  • Minor cuts, bruises and abrasions
  • Ankle sprains, damage to nerves and tendons
  • Broken and fractured bones
  • Multiple fractures and internal bleeding
  • Head, spine and neck injuries
  • Sustained life limiting injuries such as broken back or head trauma
  • In the worst cases falling can cause death

All our expert lawyers can help you understand the levels of care you might need and help you to navigate the claim based on the seriousness of you injury.

After you’ve contacted us, we’ll set up a free initial consultation to discuss how it was you came to fall from height, how high you were, what sort of precautions were in place, if any and what injuries you sustained. This will allow us to understand if you have a legal claim. We’ll discuss what funding options are available to you to pay for your claim, including No Win No Fee agreements*.

We’ll then get in touch with employers, Health and Safety officials, equipment manufacturers and anyone else responsible for your accident at an early stage to see if they accept the blame for your injuries. If they accept responsibility, we’ll try to secure interim compensation payments which can fund private medical care and ongoing expenses, before your claim fully settles. Any interim payments will be taken out of your final compensation award.

Our lawyers will look into your case in detail, gathering evidence from independent medical professionals and health and safety specialists. These experts will analyse why your fall happened and can determine any future implications to your health. They’ll also advise us on the care you’ll need in the future and any precautions that need to be implemented in your workplace.

In the very worst cases, falls from height can cause death. Even falls from not very high can have serious consequences, if you fall onto other objects or land badly.

We understand what a traumatic experience losing a loved one in a workplace accident is, having helped many families in similar situations. If someone close to you has died, our lawyers could help you with:

  • Recovering compensation for their pain and suffering, to account for financial losses caused by their death and to cover funeral expenses.
  • Representing you at inquest
  • Getting you the answers and apology you deserve from those responsible

Our lawyers could help you access a statutory bereavement award, which is separate to a claim for compensation and recognises the fact that your loved one died wrongfully. This is available if you’re the spouse, civil partner or parent (if they’re under 18) of the person who died.

Kyle's Story

Helping Kyle Claim Compensation After A Fall On A Building Site Construction Accident

Kyle, a rope technician, was working on a construction site in Canary Wharf, London, when he fell from the third floor and suffered multiple injuries.

Kyle was removing netting when the clamps he was attached to slid off a steel beam through a gap Kyle was unaware of. He fell eight metres from the third floor, fracturing his spine and breaking his ankles and wrists.

After the fall, Kyle was taken to Royal London Hospital where surgeons performed several operations. Kyle spent two years bedbound, living with his parents and relying on them for round-the-clock care to help him with basic tasks as well as manage his pain.

Our expert construction claims solicitors helped secure Kyle a £900,000 compensation settlement from his ex-employer. The compensation will cover the costs of specialist rehabilitation and care to help Kyle make the best possible recovery from his injuries. It also cover his lost earnings while he’s unable to work and give him financial security for the future.

"I hope that speaking about my experiences highlights the importance of workplace safety and ensures no one else faces what I have.” – Kyle Hunt, client.

"While nothing will ever change what has happened, we’re pleased to have secure Kyle his settlement which will ensure that he can access vital rehabilitation to help him move forward with his life.” - Natasha Fairs, Senior Associate Solicitor

Frequently asked questions

What fall from height claims does Irwin Mitchell have experience of?

Our personal injury lawyers have represented people in many different kinds of fall from height claims. Certain jobs and industries are more at risk of injury, with accidents often involving:

  • Fragile material such as skylights or unsafe tiles
  • Falls from steelwork, ladders, stairs, edges, openings and scaffolding
  • Inadequate or missing protective equipment

Employers must take the necessary precautions to protect their workers from harm, but all too often we see clients who have been failed by their company. Some of the most common examples of people we help include:

  • Construction workers
  • Window cleaners
  • Roofers
  • Engineers
  • Warehouse operatives

If you or a loved one have been injured by a fall from height, our solicitors could help you claim compensation. Call us on 0800 056 4110 to talk with one of our legal advisers about your case.

What duties does an employer have towards its employees?

Employers have a responsibility to protect their employees from danger as much as is reasonably possible. In practice this can mean different things according to the situation, but there are broad rules around equipment and safety procedures that employers should follow when appropriate.

It’s important to reduce the risk of a fall happening in the first place, either through mobile elevating work platforms (MEWPs) or robust scaffolding systems. Through the use of a restraint lanyard, employers could also stop workers from reaching the edge of an area where they’re at risk of falling.

The consequences of a fall should also be minimised wherever possible. Employers can do this by using:

  • Safety nets
  • Air cushions/soft landing systems
  • ‘Fall arrest’ lanyards to slow a worker’s descent if they fall
  • Suitable rope access equipment

We’ll investigate the circumstances around your fall, working out whether your employer should have done more to protect you. Our solicitors have decades of experience helping people who have been injured at work, so we know how to hold those responsible for your injury to account.

For more information about making a claim, please phone us on 0800 056 4110 for a free initial consultation.
