An 11-year-old girl was struck by a car on a pelican crossing on her way to school. She suffered very significant head injuries.
The child's mother instructed another firm of solicitors, who obtained a copy of the police accident report. The report detailed a number of independent witnesses, none of whom were contacted before a road traffic expert was brought in to prepare a reconstruction report.
This report was based purely on the police report and photographs. Only afterwards were the independent witnesses contacted, but merely to establish if they were willing to assist. Shockingly, the onus for contacting some of these witnesses was passed to the injured girl’s mother.
Not only that, but the solicitors involved were aware that there was a police reconstruction report, but they failed to obtain a copy before reaching a compromise and settling the claim at £10,000.
Unhappy with the result, the claimant’s mother approached us here at Irwin Mitchell. Our accident investigation team located some of the witnesses, interviewed them, conducted a site inspection and prepared a new reconstruction report.
The team also obtained additional police information and this, together with our in-house report, led to the grant of public funding to claim against the original legal advisers for professional negligence. We secured a settlement of £300,000 for the family.
