A Note On Our Fees

We pride ourselves on the transparency of our fees and understand our clients’ desire for clarity over the cost of their transaction. Unfortunately, it is not always possible to anticipate at the outset complications and issues which may arise in the course of the transaction.

These unexpected factors can vary widely in nature and may mean additional time and expertise is required to ensure the transaction proceeds, or to fully comprehend or mitigate the risks you are facing when continuing with the transaction. We will always contact you to discuss in advance any changes to the fees we originally estimate.

Our fees are calculated by reference to our hourly rates which vary depending on the member of staff dealing with your matter. Our lowest hourly rate is £215 plus VAT for a paralegal and our highest hourly rate is £590 plus VAT for a senior partner.

Where our fees fall within the value ranges set out below will depend on a number of factors including the complexity of your transaction, whether the property involved is freehold or leasehold and the expertise required to provide the high level of service we always strive to deliver. However, we cannot always provide an accurate fee estimate based purely on the property value. The difference between the lower range and the higher range can be substantial. We therefore invite you to contact us as soon as possible to discuss the particulars of your transaction, after which we will be able to provide you with a more accurate estimate.

Selling A Property

Our minimum legal fees for selling a property are set out in the table below and vary depending on the value of the property you are selling. Our legal fees can be up to 0.75% of the sale price of the property. VAT is chargeable on our legal fees at 20%.

£2,050 - 0.75% of the sale price.

£4,250 - 0.75% of the sale price.

Our legal fees cover:

  • Obtaining title information and documents from the Land Registry
  • Gathering information from you and third parties necessary to issue the contract and related information to the Buyer’s legal representatives
  • Handling pre-contract enquiries raised by the buyer
  • Redeeming the first legal charge (mortgage) on the property (if applicable) and undertaking the exchange and completion procedures.

Upon completion, we need to submit the balance required to redeem any existing mortgage to your lender by telegraphic transfer. Our fees do not include the telegraphic transfer fee, which costs £40 (+ VAT at 20%). If there is a surplus due back to you and you need this repaid by telegraphic transfer, a further £40 plus VAT at 20% will be payable Tax advice is also not included in our fee. However, we have a dedicated tax team and will be happy to pass on your details.

In accordance with our obligations under the accreditation, your transaction, where appropriate, will comply with the Conveyancing Protocol (2019 edition) and will use the Law Society Code for Completion by Post (2019 edition).

Disbursements (not included in our legal fees set out above.)

Disbursements are costs related to your matter that are payable to third parties. We handle the payment of disbursements on your behalf to ensure a smoother process.

The following disbursements usually always apply:

  • Office Copies/Land Registry Searches/Bankruptcy searches to confirm everyone involved can go ahead with the transaction. We usually provide an estimate of £50 (+VAT at 20%) to cover these costs however you will only pay the amount we actually expend. 

Once we have reviewed the documents relating to your sale we will let you know if any other disbursements are likely to be payable, for example, fees payable to a ground landlord/management company for leasehold information.

Buying A Property

Our minimum legal fees for buying a property are set out in the table below and vary depending on the value of the property you are buying. Our legal fees can be up to 0.75% of the purchase price of the property. Please note that VAT is chargeable on our legal fees at 20%.

Our legal fees cover:

  • Assessing the seller’s title
  • Raising pre-contract enquiries
  • Reviewing the mortgage offer and lender’s requirements (if applicable)
  • Obtaining and assessing all standard searches
  • Reporting our findings to you (and your lender)
  • Undertaking the exchange and completion procedures
  • Following completion, we will arrange for the payment of Stamp Duty Land Tax (“SDLT”) and forward the return on your behalf as well as apply to the Land Registry to register your purchase, deal with any requisitions and forward to you a copy of the completed title.

Upon completion, we need to submit the balance purchase monies to your seller’s solicitor by telegraphic transfer. Our fees do not include the telegraphic transfer fee, which costs £40 (+ VAT at 20%). If there is a surplus due back to you and you need this repaid by telegraphic transfer, a further £40 plus VAT at 20% will be payable.

Tax advice is also excluded as a standard part of the conveyancing transaction fee. We are able to refer you to our dedicated tax team if this is required.

  • Searches to identify potential risks with the property. These are usually around £350 (+ VAT at 20%) but vary between properties and if you want us to carry out additional non-standard searches
  • Land Registry Fees. These vary depending on the value of your property. Further information about these fees can be found .gov website.

You will also need to pay Stamp Duty Land Tax when purchasing a property but the amount depends on the value of the property you are buying. You can calculate the amount you will need to pay by using HMRC’s website or if the property is located in Wales by using the Welsh Revenue Authority’s website.

Once we have reviewed the documents relating to your purchase we will let you know if any other disbursements are likely to be payable.

Mortgaging/Remortgaging

Our minimum legal fees for mortgaging or remortgaging a property are set out in the table below and vary depending on the value of the property. Our legal fees can be up to 0.50% of the value of the property. VAT is chargeable on our legal fees at 20%.

Our legal fees cover:

  • Liaising with the existing mortgage lender (if applicable) and reviewing the mortgage offer and lender’s requirements
  • The completion procedure
  • Your lender may require searches, in which case we will obtain and assess all standard searches, reporting our finding to you (and your lender). Your lender may accept no search indemnity insurance as an alternative and we will explore this option with you when we have received the mortgage offer from your lender
  • Following completion, we will apply to the Land Registry to register the mortgage, deal with any requisitions and forward to you a copy of the completed title.

    1. If your original conveyancer didn’t carry out searches when you bought your property, your new lender may ask for a special insurance policy. This protects you and the lender in case you have to sell the property at a loss due to a problem that a search would have flagged.
    2. We charge a fee for setting up the policy and will let you know the cost of the policy itself once we have the full details.
  • Land Registry Fees. These vary depending on the value of your property. Further information about these fees can be found by visiting the .gov website.

Once we have reviewed the documents relating to your transaction we will let you know if any other disbursements are likely to be payable.

What's The Legal Process For Buying A Property?

Regardless of whether you’re buying your next home or adding to your portfolio, the process for buying property is exactly the same from a legal point of view. Once you’ve made an offer and had it accepted, your next step should then be to instruct a solicitor.

Pre-Exchange

We will carry out all the due diligence to give you a full picture of the property before you legally commit yourself to the purchase. We will request contract papers for the transaction and undertake surveys, searches and enquiries on the property. This is also the time to make sure that all finances are arranged.

We will send you all the information once it’s ready and we’ll ask you to sign the contract if you are happy with the details. You will need to send us the agreed deposit at this stage (usually 10% of the purchase price). 

You will also need to agree a completion date with the seller. This is when payment must be made and you will legally become the new owner of the property.

Exchange of Contracts

The transaction becomes legally binding when buyer and seller exchange contracts. Once the exchange has been made, you will be committed to completing the transaction on the date agreed.

Between exchange and completion we will send you a completion statement, showing the total payment we will require in order to complete the transaction. We will also request your mortgage advance (if any) from your lender.

Completion

On the agreed completion date, we will send the funds to the seller’s solicitor. When the seller’s solicitor has received them and the seller has vacated the property, the keys will be released to you by the estate agents. We will then attend to any post-completion registration formalities such as the payment of Stamp Duty Land Tax and the registration at the Land Registry.

What Is Probate?

Probate is the legal process for managing a deceased person's estate. This includes specific requirements for selling or transferring ownership of the deceased's property, such as:

  • Selling a property requires evidence of your right to sell with a Grant of Probate
  • Sales also require additional clauses in the transfer contract to protect the personal representative or executor of the Will
  • Transferring a property requires a Deed of Assent, which is slightly different to the usual Transfer Deed used for property sales and transfers
