I’ve agreed a sale - what comes next?

When you have agreed a sale price, it’s time to instruct a solicitor.

The estate agent will give you a Memorandum of Sale (MOS), listing the names and addresses of everyone in your “chain”. This might just be a buyer and seller, or it can be a longer list including a seller’s onward purchase, people buying from the buyers, people buying from them, and so on.

When you bring your MOS to a solicitor, they can start work. Their role will be:

  • Making sure the seller has the legal right to sell the property
  • Preparing documents (initial contract of sale, transfer deed, stamp duty land tax form, Land Registry application)
  • Handling the fittings and Contents Form (TA10) (detailing what’s included in the sale, e.g. light fixtures, blinds and curtains, white goods, etc.)
  • Conducting searches (making sure there’s nothing in the local area like planned building projects or flood risks that could cause a problem for the buyer)
  • Writing and handling the exchange of contracts (this “locks” the sale in)
  • Handling payment of Stamp Duty Land Tax
  • Transferring funds on the day of completion
  • Registering the property with the Land Registry.

This process can be so long it feels like it’s working against you - but it’s there to protect you. Our job is to guide you through it, and reduce your risk of making a bad purchase as much as possible.
