Negligence During Labour


North Cumbria's hospitals chiefs are being sued for negligence during the labour and delivery of a birth in Whitehaven.

A high court writ has been launched by solicitors acting for Anita White, claiming damages of more than £300,000 on behalf of her daughter Katie White.

The family claim damage was sustained as a result of negligence in obstetric management by the North Cumbria University Hospitals NHS Trust.

The action relates to the birth at the West Cumberland Hospital in July 2000 and subsequent neo-natal care the family received at Penrith Hospital.

Carlisle-based solicitors have argued that the interest on any personal injury damages should be awarded to the claimant.

The North Cumbria University Hospitals Trust said all negligence claims against hospital trusts in England are now dealt with by the NHS Litigation Authority, and it would not give further comment while the case was ongoing.
