Specialist Lawyers From Irwin Mitchell Have Secured Man A Six-Figure Settlement
A father-of-three from Nottingham, who was left needing his spleen removed after being struck by a car while riding his motorbike, is speaking out about his accident as he continues his recovery.
Phillip Marshall, 64, was riding on the A38 between Ripley and Coxbench when he was hit by a car resulting in him being thrown forwards from his motorbike. The incident, which happened on 2 June 2016, left him in need of a spleen removal and with a fractured pelvis and fractured shoulder blade.
Phillip was rushed by ambulance to Queens Medical Centre, where he remained for twelve days as he underwent surgery to address his injuries. On 14 June, he was transferred to Lings Bar Hospital, Gamston, a rehabilitation unit. However, a week later he was moved back to QMC due to complications. He remained in hospital until 5 July.
After the accident, Phillip, of The Meadows, instructed specialist personal injury lawyers at Irwin Mitchell who have helped secure him a six-figure settlement. This settlement has helped fund his ongoing rehabilitation following his accident as Phillip is still struggling with the effects of his injuries.

Phillip has now joined his legal team at Irwin Mitchell in speaking out during Road Safety Week urging drivers to be aware of motorcyclists to reduce the number of bikers injured and killed on the roads.
Kelly Lingard, the serious injury specialist at Irwin Mitchell representing him, said: “Phillip suffered horrendous injuries, some of which remain with him more than two years after the accident.
“We were delighted to secure the settlement for him, giving him access to the best rehabilitation and physiotherapy, to help maximise his mobility. The extent of his injuries was so severe that his recovery is still ongoing and we will continue to support him as best we can through it.
“Phillip has been able to take advantage of a number of services within our firm, including getting advice from our Court of Protection team, Property and Wills departments. Having all his legal needs catered for under one roof has allowed Phillip to focus on his recovery. ”
The grandfather-of-five used to be very active prior to the accident, and would take his dog for long walks and go on fishing and camping trips. However since his accident, Phillip has been unable to walk for long periods of time. He is now back to going away which he really enjoys but choses B&B to camping now.
Phillip, who had been given the motorbike he was riding the day of the accident by a friend as a thank you, said: “In some ways I think I am lucky because I don’t remember much about the accident.
“Unfortunately, I know only too well the pain my injuries have left me in since the day of my accident. I used to be an active person, and very independent, but I have had to rely heavily on my children to support me since the accident.
“I appreciate the outcome of the accident could have been worse for me and I have been determined to work hard on my recovery since leaving hospital.”
Phillip added: “I am thankful to my legal team at Irwin Mitchell for their hard work on my behalf and for their support throughout the last two years. They helped secure early rehabilitation to assist in my recovery and set up a Trust for me. They have also supported me with other legal matters.”
The driver of the car that hit Phillip was found guilty of the driving without due care and attention on 21 September 2016.
Road Safety Week runs from 19-25 November. This year’s ‘Bike Smart’ theme aims to reduce the number of cyclists and motorcyclists killed or injured on the roads.
In 2016 a total of 19,297 motorcyclists and 18,477 cyclists were either killed or injured, according to the most recent figures from the Department for Transport.
