Biography

Kunal heads Irwin Mitchell's London Restructuring and Insolvency team, dealing with a broad range of both non-contentious and contentious work.

Kunal focuses primarily on transactional / advisory work such as:

  • Debt / Equity restructuring including Restructuring Plans
  • Business sales and acquisitions
  • Lender security enforcement and enhancement
  • Cross-border restructuring & insolvency.

He acts for a mixture of UK clearing banks, alternative lenders, private equity funds, asset-based lenders and UK top 20 advisory firms. He also works with international clients such as international accountancy firms, foreign and international banks, and foreign law firms. Kunal advises secured lenders on:

  • Restructuring and refinancing of distressed loans
  • Forbearance
  • Standstill and modification agreements
  • Undertaking contingency planning
  • Strategic advice including in relation to security and risk assessment.

Kunal also has extensive experience dealing with contentious / insolvency litigation matters, including misfeasance actions and wrongful trading actions, antecedent transaction recoveries, cross-border asset recovery and fraud investigations.

Kunal regularly advises underperforming companies, boards of directors and investor groups on restructuring options and managing key stakeholders, and advises landlord creditors on enforcing their rights and dealing with tenant insolvency.

Key Highlights

Kunal advised on Re Houst Limited [2022] EWHC 1765 (Ch) – advising on the administration and subsequently sanctioned Restructuring Plan of short-term holiday lettings and property management business Houst Limited. This was significant and widely reported upon, as the first use of the Restructuring Plan process to secure the future of a distressed SME business, and involved the first occasion of HM Revenue & Customs being subject to a cross-class cram down as the dissenting secondary preferential creditor.

Following his work on the Houst, Kunal won the prestigious Corporate Restructuring Lawyer of the Year award at the Global Turnaround, Restructuring and Insolvency (TRI) Awards in 2022.

Kunal also recently advised on the sale of the business and assets of Kin Series Holding Ltd (KSHL) and Bron Releasing UK (BRL), relating to the Kin television series, to LPF Kin Holdings UK Ltd. The transaction followed the successful sale of assets by the BRON Studios group in January 2024 under the Companies’ Creditors Arrangement Act (CCAA) in Canada, which subsequently received recognition in the United States under Chapter 15 of the U.S. Bankruptcy Code.

Awards

Awarded "Corporate Restructuring Lawyer of the Year" at the Global Turnaround Restructuring & Insolvency (TRI) Awards in 2022. The award was in recognition for the work Kunal undertook on the high-profile Re Houst Limited restructuring plan case, as well as his notable work on cross-border restructuring and insolvency matters.
