What is a sponsor licence?

Any organisation that plans to employ foreign nationals will in most cases need to have a sponsor licence in place or will need to apply for one.

A sponsor licence is a formal authorisation from UK Visas & Immigration (“UKVI”) which allows businesses to employ foreign nationals under the UK’s points-based immigration system. Having a sponsor licence enables organisations to sponsor migrant workers by issuing them with a Certificates of Sponsorship (“CoS”), which the worker needs to use to apply for their sponsored visa. 

The eligibility assessment goes further than the basic checklist and requires clear evidence that an organisation: 

  • Has lawful presence in UK
  • Is financially and operationally capable of meeting the sponsor duties
  • Is ready to meet ongoing compliance duties as a sponsor. 

An organisation will also need to provide evidence that the roles they wish to fill with foreign workers are a genuine vacancy and meet the route specific criteria.

When applying, it is important to specify the type of licence an organisation will need during the application process as they will be able to only hire foreign nationals who fall under the scope of the granted licence(s).

Sponsor licence application process

  1. Prepare the online application
    The sponsor licence application is completed and submitted online through the Home Office system.

     

  2. Submit supporting documents
    After the online submission, the organisation must email the required supporting documents to UKVI.
    This must be done within five working days of submitting the application.

     

  3. Demonstrate business credibility
    As part of the application, the business must show that it is a genuine organisation, operating lawfully in the UK.

     

  4. Prove financial viability
    The organisation must demonstrate that it is financially stable and capable of meeting the responsibilities associated with holding a sponsor licence.

     

  5. Show adequate HR Systems
    The business must have appropriate human resources systems and processes in place to manage sponsored workers and comply with all Home Office duties.
