Human Rights Lawyers

No matter who you are, you have human rights. Public bodies and organisations such as the government, the police, hospitals, schools, councils and courts have a legal duty to respect and protect those rights at all times.

If a public body acts unlawfully, unfairly, or outside its powers, you may be able to bring a claim for compensation or challenge its decision through judicial review.

What counts as a violation of human rights?

Human rights underpin every aspect of our lives, but some of the key principles involve:

  • The right to life
  • The right to a private and family life
  • Freedom from degrading or ill-treatment
  • The right to liberty.

If a public body has provided a bad service, or a decision feels unfair, this is not violation of human rights. To bring rise to a claim, we must be able to show that a public authority’s actions were unlawful and led to serious harm.

The types of cases we commonly deal with include:

  • Deprivation of liberty in care homes or other care settings
  • Advice regarding concerns about care delivery and decision-making in health or social care
  • Death or serious injury while in state detention (including detentions under the Mental Health Act)
  • Mistreatment or false imprisonment by the police.

Human rights can be breached in many circumstances, but some individuals are more vulnerable than others, such as:

  • People with complex care needs
  • Children with special educational needs (SEN)
  • Adults who lack capacity
  • People in police custody or other state detention.

Infringement of your human rights can take on many forms, and you need a legal team that understands the nuances of these cases across different areas of law.

Our Public Law and Human Rights experts have the expertise you need to build a strong case and will fight to get you the justice you deserve.

Finding you the right advice

If you believe you have suffered an infringement of these rights, we could help you make a claim. Our expert solicitors have extensive experience challenging human rights abuses.
  • Actions Against the Police

If you or a loved one have been significantly impacted due to police misconduct, our expert lawyers may be able to help you get the answers and the compensation you deserve.

  • Data Protection

The General Data Protection Regulation (GDPR) and the Data Protection Act 2018 impose strict requirements, and failing to adhere to them can result in fines, regulatory scrutiny, and reputational harm.

  • Deprivation of Liberty

Hospitals and care homes can legally restrict the freedom of people who can't make decisions for themselves to provide care and treatment. If you or someone you know is facing restrictions that you think are unfair, we may be able to help.

  • Education Law

Our specialist education law solicitors help families, young people, and education professionals resolve issues ranging from Special Educational Needs (SEN) support to school exclusions, disability discrimination, Ofsted challenges and disputes with local authorities.

  • Inadequate Health or Social Care

If care, treatments, or facilities you were depending on have been cut or denied, we can advocate to get you reconnected with the help you need.

  • Judicial Review

If a public body makes a decision that breaches the Human Rights Act,  you can challenge them through the judicial review process.

Who can make a human rights claim?

Anyone who has had their rights infringed or has been treated unlawfully by a public body can make a claim. You can also act as litigation friend for adults who lack capacity to make decisions for themselves for reasons of cognitive impairment, or children.
