How long do children’s serious injury claims take?
Children’s serious injury claims can often take between two and five years to settle because of several factors:
- Medical prognosis: It can be hard to understand the full extent of your child’s injuries while their brain and body are still developing. It’s important not to rush into settling your child’s claim to make sure all possibilities are considered.
- Calculating future losses: Without the full impacts of your child’s injury being known, calculating future losses can be difficult. We need to make sure all long-term care costs, specialised equipment, and any reduction in future earning abilities are considered.
- Court approval: Because the injury is to a child, any settlement must be approved by a judge at an Infant Approval Hearing. This is to make sure the settlement is in the best interest of the child.

Do children’s serious injury claims go to court?
While most of the children’s serious injury claims we handle are settled out of court, we will need approval from the Infant Approval Hearing.
This is a short hearing where a judge will review the settlement to make sure it protects the child’s long-term interests and is fair.
A court case will only be needed if something, such as who is at fault or your child’s long-term prognosis, can’t be agreed on.
Even when a court date is set, many claims are settled before the start of the trial.
