Data shows that in 2024/25, Irwin Mitchell received the most in legal fees from NHS Resolution for supporting patients with their medical negligence claims than its competitors.

We received £88.9 million, out of the NHS’s total £332 million spend on patient‑side legal costs, meaning that for every £4 the NHS spent, more than £1 came to us.

What is NHS Resolution? NHS Resolution is a public body that works on behalf of the NHS to handle complaints, concerns and legal claims fairly. It manages clinical negligence and other claims made against NHS organisations, responds to Freedom of Information requests, and uses learning from claims to help improve patient safety and protect NHS resources for patient care.

A Freedom of Information request published by NHS Resolution (data as of 31 March 2025) sets out the top 20 claimant law firms for clinical negligence claims in the 2024/25 financial year, based on both claimant legal costs paid and volume of claims. The data shows that total claimant legal costs paid to these firms amounted to £332 million.

While Irwin Mitchell recorded the highest total claimant legal costs, it did not handle the highest volume of claims. Irwin Mitchell dealt with 1,248 claims, compared with Fletchers, which handled a higher number of claims overall (1,309) but generated significantly lower total claimant legal costs.

Claimant Legal Costs include "damages" (patient compensation paid), and "claimant costs" (patient legal fees) paid by NHS Resolution.
