What constitutes professional negligence?

Professional negligence occurs when a person acting in a professional capacity fails to meet the standards reasonably expected of them, and that failure causes harm or loss to a client or third party.

A professional will not usually be considered negligent simply because a mistake was made or a service fell below expectations, as long as there was no harmful outcome or loss. Equally, a poor outcome does not automatically amount to negligence if the professional acted reasonably and in accordance with accepted professional standards.

Examples of professional negligence include:

  • A solicitor giving incorrect legal advice or missing a critical court deadline
  • An accountant giving incorrect tax advice
  • A medical practitioner misdiagnosing a patient
  • A building surveyor failing to identify structural defects during a property survey.

Whether a claim has been made against you or your business, or you’re seeking to reduce future risk, we can help. Contact our professional negligence solicitors to get specialist legal advice.
