When could I make a package holiday claim for compensation?
If you have been injured or become ill through no fault of your own while on a package holiday, you could be eligible to claim compensation.
Some of the most common reasons why you may need to make a package holiday claim for compensation include:
- Food poisoning
- Injuries sustained during the transfer to your hotel from the airport
- Injuries sustained at your accommodation
- Injuries sustained during an excursion
- Illness caused by unsanitary conditions.
We are currently pursuing group compensation claims for holidaymakers affected by illnesses in:
Please note, we can only help those who have become ill or injured while on holiday. We aren’t able to accept claims for issues such as:
- Bad holiday experiences or customer service
- Cutting your trip short due to unforeseen circumstances, which may be referred to as curtailment on legal or insurance paperwork
- Poor excursions.
How long do I have to make a package holiday compensation claim?
If you booked your package holiday in the UK, the time limit for making a claim is normally three years. This time limit starts from the date of the accident or illness.
The three-year limit doesn’t apply to:
- People without the mental capacity to make their own claim
- Children under 18 years old—the limit begins on their 18th birthday, meaning they have until they turn 21 years old to make a claim
- Deceased individuals—the time limit begins three years from the date of the person's death or three years from the date of knowledge, whichever is later.
However, the time limits for making a claim in other countries is often shorter than three years. For this reason, you should get in touch with us as soon as you can. Starting your claim soon after the accident also means evidence is more readily available for us to collect.
