Prenuptial & Other Agreements

Few of us enter into marriage or a civil partnership anticipating it to break down but in these modern times it pays to be practical when making one of the most emotional decisions of your life. Our private client lawyers can help draft pre- and post-nuptial agreements to help protect your wealth, assets and family in case of divorce.

High net worth individuals are not just concerned with preserving wealth for themselves, but for future generations – particularly when trusts and inherited property are concerned. Working with Irwin Mitchell’s expert commercial, wealth management and tax planning solicitors, we can help you draft agreements that do just that.

Our work in this area considers both existing wealth and wealth that was built up over the course of the relationship. We can also help you protect potential future wealth you expect to acquire after the agreement has been signed and make provisions for the care and education of your children.

It’s never easy when a relationship breaks down, but a well-drafted agreement from our award-winning solicitors can smooth the divorce process for both parties, keep legal costs to a minimum and safeguard your financial position.

The Negotiation Process

Agreements are not legally binding documents, which is why it is important that they are properly drafted and negotiated to ensure that they are upheld by the court if divorce does happen. A court will generally uphold an agreement that two people have willingly entered into, provided that the necessary formalities have been complied with and the agreement is not unfair – particularly to any children.

Having a well-negotiated agreement in place doesn’t just help protect assets but provides certainty for both parties and helps prevent arguments if divorce does happen, keeping legal costs down and easing the transition for any children involved. Our solicitors understand that these agreements are more than just financial arrangements and are skilled negotiators in the sensitive context of personal relationships.

Living Together & Cohabitation Agreements

Many people do not know it, but living with someone does involve certain legal complexities even if you aren’t married. Living with someone may give you certain rights you don’t know about and may put you under financial obligations as well. Similarly, you may not have acquired the rights that you thought you had.

If you are considering living with someone but not necessarily getting married it is important to take legal advice about the potential consequences. A living together or cohabitation agreement may save a lot of argument and expense in the future as the law in this area remains particularly uncertain.
