When should you consider separation?

Going through a formal separation works best when:

  • Both you and your partner are in agreement
  • You can both still discuss matters openly and productively (even if it gets difficult at times).

How does a separation agreement work?

You’ll work with solicitors to agree on things like:

  • Child maintenance payments
  • How to divide bank accounts, savings, and debts
  • Who will live where, and who will pay the mortgage and bills
  • Who your children will live with and other access arrangements
  • If you’re selling a house, how proceeds will be divided between you
  • How to divide your personal possessions (like cars, furniture, and sentimental items).

If you later decide to divorce, this agreement may provide the basis for a Financial Consent Order, which becomes legally binding when the Decree Absolute is granted in divorce proceedings. 

The upside of this is a potentially lower-cost divorce, as you won’t need to mediate through these issues, or go to court. (But if you’re struggling to agree on the terms, mediation can help).
