To start your claim, contact our team. We’ll arrange a free initial consultation where you can tell us what happened to you while on holiday. We’ll advise you on if you could make a claim, how much compensation you could be entitled to, and the funding options available to you.

You don’t need to go any further than this consultation if you don’t wish, but if you choose to go ahead with your claim, we’ll begin by gathering all available evidence.

Evidence we may use to support your claim includes:

  • Witness statements
  • Photographs and/or CCTV footage
  • Receipts
  • Medical records
  • Complaint records.

If necessary, we’ll also arrange for you to be examined by an independent medical expert. Their expert opinion can be a vital piece of evidence when proving that your injury or illness was the fault of the tour operator.

We work to keep claims from going to court, but we may need to initiate court proceedings if the individual or organisation responsible for your illness or injury doesn’t admit fault. We may also need to do this if they dispute the amount of compensation we’re claiming for.

If you booked your package holiday in the UK, the time limit for making a claim is normally three years. This time limit starts from the date of the accident or illness.

The three-year limit doesn’t apply to:

  • People without the mental capacity to make their own claim
  • Children under 18 years old – the limit begins on their 18th birthday, meaning they have until they turn 21 years old to make a claim
  • Deceased individuals – the time limit begins three years from the date of the person's death or three years from the date of knowledge, whichever is later.

However, the time limits for making a claim in other countries is often shorter than three years. For this reason, we urge you to get in touch with us as soon as you can. Starting your claim soon after the accident also means evidence is more readily available for us to collect.

How long does it take to settle a package holiday claim?

There’s no set amount of time for settling a package holiday compensation claim. The circumstances around each claim dictate how long your claim may take.

A major factor in how long your claim takes is whether your opponent admits liability for your injury or illness. If they accept responsibility and the amount we’re claiming for, we’ll be able to settle your case swiftly.

If they dispute fault, we’ll have to prove it, which means we may need to begin court proceedings. We work to keep claims from going to court, but if we need to start this process, we’ll be with you every step of the way.

No matter how long your claim takes, we won’t rest until we’ve done all that we can to get you the compensation you’re entitled to. We’ll act on your instructions and make sure you’re fully informed and supported throughout the process.

Will I be making a claim abroad or in the UK?

If the package operator is based in the UK, it's usually best to pursue your claim in the UK. However, in some circumstances, you may be able to get more compensation if we pursue your claim abroad.

At the beginning of your claim, we’ll advise you on what your options are and what is best for you.

If the package operator isn't based in the UK (which is unlikely), or if you will get a better outcome by doing so, then you might pursue your claim abroad.
