You might not realise you’ve been affected by medical negligence until after your injury or condition becomes worse, so you may not consider making a claim directly after experiencing medical negligence. But that doesn’t necessarily mean you’ve missed your chance – you have three years following any suspected incidence of medical negligence to start a claim. Even so, if you suspect you have a problem due to medical negligence, don’t delay. Contact a solicitor at your first opportunity to ensure your claim is made within time.

There are some exceptions to these time limits:

• Children – you can make a claim involving a child any time before they turn 18. The three-year rule comes into effect on their 18th birthday, so the claim will need to begin before they turn 21.
• Mental capacity – there is no time limit for making a claim on behalf of a person lacking the mental capacity to make the claim themselves.

How long medical negligence claims take to settle depends on things like the severity of your injury or condition and whether the NHS or private healthcare provider responsible accepts fault.
