Surrogacy is a legal arrangement where a woman carries and gives birth to a child for another person or a couple. Under UK law, the intended parents are not automatically the legal parents of the child and therefore the UK immigration status of the intended parents is not always passed on to the child.

When surrogacy arrangements are made overseas, this involves a careful consideration of the individual circumstances of the family and of the surrogate. Our immigration solicitors assist by establishing the child’s position for the purposes of immigration and nationality law, to help navigate the most straightforward path for the family to return to the UK following the birth of their child.  

There are a number of ways in which we support families, depending on their circumstances, which can include:  

• Considering whether a child has automatically acquired British citizenship, and assisting with a British passport application or a Certificate of Entitlement to the Right of Abode.  
• Assisting with nationality applications, such as an application to register the child as a British citizen.  
• Assisting with visa applications under, and at times outside of, the Immigration Rules.
