Penalties for driving without insurance
If the police issue a fixed penalty, you may receive:
- Six penalty points
- A fine
If your case goes to court, the magistrates will sentence you in line with established sentencing guidelines for driving without insurance. The level of sentence depends on the seriousness of the offence, which is assessed by the court.
The sentencing ranges are as follows:
- Category 1 - Six to eight penalty points and a fine
- Category 2 - Disqualification up to 6 months OR 8 points and a fine
- Category 3 - Disqualification of 6-12 months and a fine
The court will determine which category your case falls into by assessing the seriousness of the offence. Generally, less serious cases fall into Category 1, while more serious cases fall into Category 3. The court will consider factors such as whether false details were given, whether there was sustained uninsured use, or whether an accident occurred.
Our solicitors will present your case clearly and persuasively to achieve the most lenient outcome available.

Defences to driving without insurance
Driving without insurance is a strict liability offence - meaning you are either insured or you are not. However, certain situations may allow the charge to be withdrawn or may help you avoid penalty points.
1. Insurance Company or Administrative Errors
We can assist you in contacting your insurer to determine whether the policy failed to renew, was cancelled incorrectly, or was otherwise affected by administrative error. If so, we may be able to obtain a letter of indemnity, which can result in the charge being dropped.
2. Special Reasons
Special reasons do not amount to a defence, but if accepted by the court, they can prevent the imposition of points or a disqualification. Examples include:
- You were misled into believing you were insured (e.g., a family member handled the policy)
- A genuine emergency required you to drive.
