These legal matters are so important but they’re not always easy to understand, especially when you’re just starting out and trying to understand what help is available and how it can get you where you need to be. Here are some of the questions we hear most often.

How do I make a Will?

Making a Will is simple. There’s a few ways to do it:

Online – the questionnaire only takes ten minutes to complete
By post – download the form and send it back to us
By phone – call and speak to us.

We recommend our online or postal service if your estate is relatively straightforward. If you have more complex requirements, or you’d like to talk about tax-planning or asset protection options such as setting up a trust, we advise speaking to us on the phone or coming in to see one of our experts.

What's the process for making a lasting power of attorney?

First you’ll need to draft a document that lays out what your attorney can and can’t make decisions about. It’s vital to do this with a solicitor to ensure it’s valid.

Once it’s finalised, you’ll need to sign it in the presence of a witness. Your certificate provider will then go through it with you to you understand what you are signing and are not under any undue influence. If you’re making an LPA through Irwin Mitchell we’d act as your certificate provider.

The LPA will then have to be registered with the Office of the Public Guardian before it can be used.

What is Probate and grant of probate?

The word ‘probate’ is often used to refer to the entire process of administering a dead person’s estate. This involves organising their money, assets and possessions and distributing them as the will instructs – after paying any taxes and debts.

More specifically, a Grant of Probate is a legal document that confirms someone as the executor of an estate. This document gives them the authority to deal with the deceased’s assets.

If you have been named as someone’s executor in their Will, you need to apply for a Grant of Probate before you can begin administering their estate as per their instructions.
