Group B Streptococcus Claims

Trustpilot

Group B Streptococcus (GBS) is the most common cause of severe infection in new-born babies and unfortunately mistakes happen that can cause serious complications. If your child has suffered due to substandard group B streptococcus treatment, our medical negligence solicitors could help you make a compensation claim.

GBS is a bacteria carried by roughly one in five pregnant women in the UK and there is a small risk that the bacteria can be passed to a baby during childbirth. Potential complications of this infection include:

  • Blood poisoning (sepsis)
  • Lung infection (pneumonia)
  • Brain lining infection (meningitis).

Sadly 6-7% of babies with a GBS infection die due to one of these complications and 9-10% are left with long-term disabilities such as:

  • Cerebral palsy
  • Brain injury
  • Blindness
  • Deafness
  • Serious learning difficulties.

Measures can be taken to prevent GBS infections and treatment provided to promote a full recovery for the baby. However, late diagnosis or substandard medical care can increase the risk of complications.

If your child has developed a disability due to negligent GBS treatment, we may be able to help you make a compensation claim.

Our solicitors are experienced at representing the parents of babies with GBS-related disabilities. We can help ensure the best possible quality of life for your child by securing the funds you need to pay for therapy, home adaptations, disability aids and other costs.

Call free on 0800 121 6567 or contact us online to speak to one of our specialist advisors and learn more about how you can claim.

Group B Streptococcus Claims - More Information

After you’ve contacted us, we’ll set up a free initial consultation to discuss your case and whether you have a legal claim on behalf of your child. We’ll discuss what funding options are available to you to pay for your claim, including a No Win No Fee agreement*.

We’ll then get in touch with those responsible for your child’s negligent treatment at an early stage to see if they accept the blame for your child’s injuries. If they accept responsibility, we’ll try to secure interim compensation payments which can fund private medical care and ongoing expenses, before the claim fully settles. Any interim payments will be taken out of your final compensation award.

Our experts will look into your case in detail, gathering evidence from independent medical professionals. These experts evaluate what care your child should have received and can determine any future implications to their health. They’ll also advise us on the care they will need in the future.

We’ll always try and negotiate claims out of court, keeping the claim process as short as we can. However, if your opponent doesn’t accept responsibility or doesn’t agree with the amount of compensation we feel you need, we’ll start court proceedings.

Even when trial dates have been set, claims are still often settled before reaching court. If your claim does need to go to court, we’ll be there to help you every step of the way, talking you through what will happen so you feel as comfortable as possible.

In most medical negligence cases you have three years to make a compensation claim, starting from the date the injury happened (or the date you first became aware that the injury was a result of negligence). For children, this three year period begins on their 18th birthday, so you have until they’re 21 to make a claim.

However, there’s no time limit for people with profound mental difficulties (this applies to many cerebral palsy cases, for example). So, even if you didn’t make a claim for a loved one with cerebral palsy within the usual time limits, you can still begin a claim with our solicitors later on.

It’s important to contact us as soon as possible so that we can begin to investigate your claim. If you have questions or concerns about the time limits, please call us for free initial advice on 0800 121 6567.

In most cases, where we are able to accept instructions, we are able to offer our clients a no win no fee agreement with delegated ATE Insurance.

This insurance policy fully protects you if your claim is unsuccessful. It also means that you can claim compensation without paying a penny upfront. You only ever pay anything if your no win no fee claim is successful, and even then, your opponent will pay most of your legal costs.

Any remaining costs are deducted from your compensation settlement. We’ll advise you of this in advance, so there won’t be any surprises.

As we can offer our clients this method of funding, we aren't able to offer clients the option of legal aid.

Many of our cases are funded with a No Win No Fee agreement. This means that there’s no financial risk* to you when making a compensation claim.

At the start of your case we’ll discuss funding options with you, advising you which we think is most suitable. If you have legal expenses insurance (LEI) or are covered by a trade union policy, these may be best for you. Legal expenses insurance is included in many household insurance policies, so it’s always worth checking whether you’re already covered.

If we think you’re best supported by a No Win No Fee agreement, we’ll explain the process clearly. This involves setting up an insurance policy that will protect you, at no cost to you. You’ll only have to pay anything when your claim is successful – your opponent will pay most of our fees.

Please visit our No Win No Fee* page for more information on how it works.

Our expert solicitors have decades of experience in medical negligence cases and are nationally renowned for their expertise. With offices up and down the country, we’re recognised by independent legal guides as one of the UK’s best medical negligence departments.

For some people getting an apology and explanation for what’s happened is just as important as a compensation award. We campaign for systems to be put in place that ensure the same thing doesn’t happen to somebody else.

Because we’re a full-service law firm, we also have a number of other in-house teams with specialist knowledge in areas such as rehabilitation, local authority funding, Wills and asset management.

Rehabilitation

We see rehabilitation as key and will make sure that you can access the care and support services your child needs to lead the best life possible. Our Support and Rehabilitation Coordinators can provide support and information to you and your family, helping you with many of the “non-legal” problems you may face such as benefit eligibility and healthcare.

Public Law & Human Rights

Our Public Law & Human Rights department can offer advice on Part 3 of the Children and Families Act 2014. The Act made sweeping reforms to child welfare legislation, affecting young people with special education needs under the age of 25. It replaced statements of special educational needs and learning difficulty assessments with a combined Education, Health and Care Plan (EHC plan).

We can advise you on:

  • The new assessment process
  • EHC plans
  • Duties of schools
  • Challenging decisions

Asset Management

Our Asset Management team can provide advice on how your compensation could be best invested so that it’s there for the rest of your child’s life. We also have Court of Protection lawyers who can set up a personal injury trust, which protects your compensation and ensures that you remain eligible for any benefits you’re entitled to.

Court of Protection

We have the largest Court of Protection department in the UK, which helps people manage their affairs when they don’t have the mental capacity to do it themselves. This means we can help you safeguard your child’s financial future.

It’s not an easy situation to deal with, but there is assistance out there which has a massive positive impact on not just Mac’s life but ours too – and we wanted to share that with others."

Frequently Asked Questions

What is a Group B Streptococcus infection?

Group B Streptococcus, also known as GBS or Group B strep, is a bacterium that lives in the digestive and genital organs. It is carried harmlessly by up to 30% of the adult population but can cause serious infection if it is passed to a baby during childbirth.

Mothers are more likely to pass GBS on to their baby if:

  • your baby is born early – the earlier your baby is born, the greater the risk
  • you have previously had a baby with a GBS infection
  • your baby is born more than 18 hours after your waters broke
  • you have a high temperature during labour

Mothers of high-risk babies are offered antibiotics during labour to reduce the risk of infection.

GBS infections that develop within seven days of birth are known as early-onset and after that they are known as late-onset. Late-onset GBS infections are not usually associated with pregnancy or childbirth.

Symptoms of early-onset GBS infections begin within 12 hours of birth and can include:

  • abnormal temperature, heart rate or breathing rate
  • irritability
  • not feeding well
  • being floppy or unresponsive

Most babies with GBS infections make healthy recoveries but 9-10% develop complications if the infection spreads to their blood, lungs or brain. These complications can in turn lead to serious long-term disabilities.

If your baby has developed disabilities following a GBS infection and you think that negligent medical treatment is to blame, you may be able to make a compensation claim. Get in touch online or by calling 0800 121 6567 to find out more.

What can my compensation pay for?

The life-long effects of a GBS infection can be very costly for a family and if medical negligence is to blame, you deserve compensation to help cover those costs. A compensation award can be used to fund:

  • speech and language therapy
  • physiotherapy
  • occupational therapy
  • home adaptations or new accommodation
  • assistive technology
  • transport to medical appoints
  • care costs

Our dedicated Support and Rehabilitation Coordinators will get in touch at the very start of your case to ensure that you get the support you need during and after your claim.

We understand that the true extent of developmental disabilities isn’t always clear until a child has grown up. We will work with specialists to fully understand the long term impact of your child’s injuries before finalising a settlement and make sure that your compensation covers their care needs both now and for the future.

Where liability is admitted we will ensure interim payments are obtained to assist with the child’s ongoing needs while a settlement is agreed. Many of our clients receive a large initial lump sum for initial costs and then yearly payments to cover ongoing expenses for the rest of their life.

Call free on 0800 121 6567 or contact us online to get in touch with a member of our specialist team to learn more about how a Group B Streptococcus Claim could help your family.
