What is pre-charge engagement?

Following an arrest or interview by police or other investigators, you will be either:  

  • Released on Police bail
  • Released under investigation
  • The Police will confirm no further action will be taken
  • Charged with an alleged offence(s).  

Unfortunately, investigations can be long and often take months, or in some cases, years.  This can be a difficult time and an uneasy process to navigate.  We can help by engaging in pre-charge engagement with the investigator.  This is where we communicate with the Police or investigator after the interview and before a charging decision is made. The process can enable new lines of enquiry, provision of material and influence the decisions made during the course of the investigation.  

Pre-charge engagement is a structured, voluntary process that allows suspects (through their legal representatives) to communicate with investigators and prosecutors before a charging decision is made. Pre-charge engagement can take different forms whether it be:

  • Contacting defence witnesses and obtaining witness statements.  
  • Obtaining and collating defence material.    
  • Influencing the decision of the investigator.  
  • Providing details of potential lines of enquiries.  

Pre-charge engagement is an effective tool to enable an early, and favourable, resolution to a case. Used correctly, it can:

  • Bring forward exculpatory material and alternative lines of inquiry.
  • Address misunderstandings and factual inaccuracies.
  • Agree sensible parameters for the review of digital material or devices.
  • Raise legal issues early (for example, legal privilege, proportionality).

In some cases, clients often do not feel as though they were able to provide sufficient information in interview or are no longer happy with their decision not to answer questions.  Pre-charge engagement can be a useful tool to help provide further information to the investigator and achieve a favourable outcome for you.
