Irwin Mitchell's professional negligence team represented a young family who had engaged a surveyor to carry out a Home Buyers Survey & Valuation Report on a property they were interested in purchasing.
In reliance on this report, the family purchased the property. Unfortunately, shortly after purchasing the property and whilst in the process of decorating, it became evident that the property had asbestos throughout. The risk of asbestos being present in the property was not highlighted in the report.
If the asbestos had been highlighted in the report, the property would not have been worth the amount that the family paid for it. This is known as 'diminution of value'.
Consequently, Liz Norris, a solicitor in Irwin Mitchell's professional negligence team, was able to secure £90,000 for the family by way of damages.
The family are extremely pleased with the successful outcome.
