Preparing for the Building Safety Levy
The Building Safety Levy, scheduled to apply from 1 October 2026, will introduce a new financial obligation on most residential developments in England.
It is designed to raise £3.4 billion for the remediation of unsafe buildings and will apply to most schemes delivering 10 or more dwellings, including Build to Rent and Purpose Built Student Accommodation (PBSA), with PBSA currently assessed from 30 bedspaces (subject to consultation proposing a rise to 120). Only a limited set of schemes such as social housing and specialist accommodation like care homes or children’s homes are exempt, requiring developers to adjust financial assumptions early in the development lifecycle.
The levy comes alongside a wider tightening of the safety regime under the Building Safety Regulator (BSR), which is expanding oversight and increasing scrutiny of residential projects. With new enforcement powers and obligations on developers to remedy unsafe cladding, the regulatory environment is shifting from encouragement to firm compliance, adding cost and programme pressure. These changes coincide with ongoing delays in the Gateway system, meaning developers must plan for additional approvals risk as part of their overall strategy.
To prepare effectively, developers should factor the levy into appraisals as early as possible, given there are no transitional protections for late stage applications. Identifying whether a scheme qualifies for exemptions or the 50% brownfield discount can help mitigate cost exposure. Internally, teams should strengthen project governance to ensure that safety information, design assurance, and Gateway documentation are fully aligned with BSR expectations.
