Why Would My Employee Take Me To An Employment Tribunal?

There are lots of reasons why your employees could bring a claim against you. The most common claims include:

  • Unfair dismissal
  • Discrimination
  • Pay (including holiday pay)
  • Breach of contract
  • Whistleblowing

There are steps that you can take to avoid tribunal claims and resolve disputes before they get to tribunal. Your internal processes, such as your grievance, harassment and whistleblowing policies, should aim to identify and resolve issues internally.

You can also use ACAS (the Advisory, Conciliation and Arbitration Service) to resolve disputes quickly. Anyone wanting to bring a claim must contact ACAS first. ACAS will try and settle the potential claim before it is even issued.

If a claim is issued in tribunal, it’s never too late to settle it, and many do. In some cases you may be offered judicial mediation by an employment judge to try and resolve the dispute without a formal tribunal hearing.
