Medical Negligence
London

5* Trustpilot review
I’m a partner in the Medical Negligence team, based in our London office. I qualified in 2014 having trained at the firm under some of the most experienced and well-regarded personal injury and medical negligence practitioners in the market.
From early on, I knew I wanted to specialise in this area, combining my interest in both law and medicine to help people understand what has happened to them and get the justice they deserve.

Medical negligence doesn’t discriminate. It can affect anyone, regardless of their age, ethnicity, background, or personal circumstances. So, I represent clients of all ages and from a diverse range of ethnic and cultural backgrounds.
I appreciate that death or injury caused by medical negligence does not just affect the individual; it affects the whole family, and my approach to representation reflects that.
Birth injury case
In October 2024, I settled a birth injury claim for a capitalised sum of just over £19 million. Liability was admitted before we began court proceedings. The claim was then valued and settled at a settlement meeting just before trial. My client lived in New Zealand, so the case had several complexities beyond what is usual in this sort of case. The family were delighted with the settlement and have just moved into their new home, with a hydrotherapy pool.
Amputation case
In February 2025, I settled a complex below-knee amputation claim for £5.5m at a Joint Settlement Meeting, 10 weeks before trial. Liability was denied. My client gave me a 5* review saying that I was a “very competent, knowledgeable and professional solicitor who was able to manage the case to a very favourable conclusion via a JSM. She is very quick at picking up any necessary knowledge and I would highly recommend her for any medical negligence case.”
Erb's palsy claim
In July 2024, I settled an Erb's Palsy claim for £1.1m. The case concerned an eight-year-old boy who suffered a left-sided obstetric brachial plexus injury (Erb's Palsy). He was left with limited use of his left upper limb. We took the case on to investigate a claim. Supportive evidence was obtained, and an admission of liability was secured before court proceedings started. We negotiated a £1.1m settlement to help fund the costs of care and rehabilitation to improve the child’s quality of life.
Spinal cord injury claim
In September 2026, I settled a spinal cord injury claim for £1.3m. Liability was denied but the parties agreed to alternative dispute resolution and a settlement was reached having exchanged key liability and quantum evidence.
This client provided the following 5* review:
“Georgie Cushing and Ellie McCague were amazing all the way through. They were so professional and were very patient and understanding. They did everything to make the process as easy as possible and I really appreciate it. I can't say enough good things about the whole team. I’m actually going to miss them all. I would recommend Irwin Mitchell and hope whoever uses them that they get the same professional ladies that I had the pleasure of.”
Birth injury claim
In September 2024, I resolved a birth injury claim on behalf of a mother and her son. Following the settlement, the mother said:
“I would like to recommend Irwin Mitchell, especially Georgie Cushing after the exceptional service she provided in securing settlement and compensation for our family in medical negligence case. Her professionalism, knowledge and compassionate approach made this incredibly difficult process manageable. She explained each step of the process and answered all our questions, giving us confidence that we were in good hands.”
Fatal claim
In December 2024, I settled a fatal claim on behalf of a widow who lost her husband suddenly and prematurely. An admission of liability was secured before court proceedings were commenced and a six-figure settlement negotiated, which exceeded expectations and gave my client the financial security she needed as she went into her retirement.
Medical negligence claims are rarely just about compensation. For many clients, they are about obtaining answers, understanding what went wrong, securing accountability, and ensuring that the right support is available for the future. Most clients also have a desire to ensure that the mistakes made in their care aren’t repeated so no other family goes through what they have. My role is to guide clients through that process and build the strongest possible case on their behalf.
Every case is different, but the process generally starts with listening to my client's experience and understanding how the medical treatment has affected their life and future. I then obtain and review the relevant medical records and work closely with leading independent experts to investigate whether the care fell below an acceptable standard and whether that caused avoidable injury.
Once the evidence has been gathered, I’ll advise on the strengths and risks of the case and develop a clear strategy. If the evidence supports the claim, I’ll present the case to the defendant and seek admissions where possible. If liability is disputed, I’ll prepare the case for court proceedings while continuing to explore opportunities for resolution through negotiation or settlement meetings.
I keep my clients fully informed throughout the process, explaining complex medical and legal issues in clear and straightforward terms and ensuring they understand every significant decision before it is made.
Where appropriate, I help them access rehabilitation, specialist support services, financial advice, Court of Protection expertise, and other resources that may improve their quality of life while the claim progresses. This holistic approach ensures that the case is focused not only on what happened in the past, but also on building the best possible future.
The first meeting is about listening to you. I take the time to understand what happened, the impact it’s had on you and your family, and what you hope to achieve from making a claim. I’ll introduce myself, the firm and my team, explain the legal process in clear, straightforward terms, discuss funding options, and answer any questions you may have.
Clients often tell me that they leave the meeting feeling reassured and supported. My aim is to provide not only expert legal advice, but also to make you feel confident that you have a trusted adviser who’ll guide you through every stage of the claim and fight to secure the best possible outcome.
Initial meetings can either take place at your house, in hospital if you’re still an inpatient, or remotely via a video call.
The immediate next steps following our meeting would be to ensure a funding retainer is in place, before requesting the relevant medical records.
