Knee Injury Compensation Claims

Suffering a knee injury can be both painful and frustrating. We understand the impact this can have on your life, from time off work to missing out on your favourite activities.  Our knee injury claims solicitors will strive to secure you the compensation you deserve.

How To Make A Knee Injury Claim

Call our team on 0800 056 4110 and we’ll take you through a free initial consultation. We’ll ask you how the injury happened, who you believe to be at fault, and how your life has been affected.

If we think you have a claim, we’ll approach the person or organisation you believe is at fault. If they accept responsibility, we’ll negotiate a compensation settlement for you that takes into account your pain, suffering and the impact on your life.

If we think you have a claim but the other party doesn’t admit responsibility, we’ll still fight for compensation for you – all the way to court if necessary.

We can help you to claim for:

  • Sprains and tears (ligament damage)
  • Strains (muscle or tendon injury)
  • Cartilage injury (meniscus)
  • Fractured kneecaps
  • Bursitis
  • Osteoarthritis
  • Faulty knee replacements.

The effects of a knee injury may be temporary or life-changing, such as needing to take time off work to recover, or to change careers if you’re no longer able to continue in your current line of work. You may also no longer be able to enjoy your hobbies.

The physical effects of a knee injury may also impact on your mental health. We’ll work to get you a compensation settlement that covers not only the physical damage, but also any psychological impacts.

How Long Do You Have To Make A Knee Injury Claim?

Generally speaking, you’ll have three years from the date of the incident to make a claim. However, there are some exceptions to these time limits, for example you may have less time if you were injured abroad.

You should contact us as soon as possible to avoid running out of time. This also gives us the best chance to gather the evidence needed to support your claim.

How Much Compensation Can I Claim For A Knee Injury?

As every case is different, there are no set compensation amounts for a knee injury. For example, if you need lifelong treatment you should receive a higher settlement. Once we understand your situation, we’ll be able to give you an idea of how much compensation you may receive. Our personal injury specialists will look at the following factors while assessing your case:

  • The severity of the pain or damage
  • Difficulty walking
  • Loss of earnings
  • Whether or not you’ll need ongoing support or further treatment.

No Win No Fee Knee Injury Claims

The majority of our knee injury claims are ‘no win, no fee’. This means that yours and your opponent’s legal fees are covered if you’re unsuccessful*. If you’re successful, your opponent will pay most of your legal costs. Any costs not paid by your opponent will be deducted from your final compensation.

Why Choose Us?

We’ve worked on hundreds of knee injury compensation claims just like yours, and have leading lawyers throughout the country. Our compassionate teams will listen to your story and strive to get you the compensation you deserve.

We understand that the effects of a knee injury can go beyond the physical damage. It might affect your ability to enjoy certain leisure activities such walking, running or playing sports. We’ll factor all this into your claim.

If needed, we can help you access rehabilitation and interim compensation payments so that you can cover immediate costs while your claim is ongoing.

Knee Injury Compensation Claims - More Information
    • What If I Don't qualify for no win no fee?
    • If your case doesn’t meet the no win, no fee criteria, there may be other options available to you.

You may have Legal Expenses Insurance on your home insurance policy, for example, or you may be a member of a trade union which covers legal expenses. We’ll discuss the best options for you during your initial consultation.

    • Who Will pay my compensation?
    • If you’re claiming against an employer, for example if you suffered a fall at work, then this will be covered by your employer’s insurance. Often, knee injury claims are against public organisations, in which case these will be covered by Public Liability Insurance. Road traffic accidents will be covered by individuals’ motor insurance.

Medical negligence claims will be against the NHS or a private medical provider, while claims for defective knee replacements may be against the product manufacturer.

For sporting injuries, your claim may be settled by the club’s insurance. Skiing injuries could be the result of poor instructor training or faulty equipment, in which case the ski resort’s insurers will be responsible for your settlement.

For criminal assault claims, the Criminal Injuries Compensation Authority (CICA) will pay out if the person who assaulted you doesn’t have the means to pay.

    • Are there exceptions to the three-year time limit?
    • Adults can make claims for children up until their 18th birthday. If they reach 18 and a claim hasn’t been made for them, they can make their own claim up until their 21st birthday.

There’s no time limit to make claims on behalf of people who lack the mental capacity to make a claim themselves.

If your claim relates to a criminal assault, generally the limit is two years. However, this can be extended in some circumstances, for example if you were too ill to claim.

If you were injured by a faulty product, you’ll have 10 years from the product launch date to make a claim.

Finally, if the injury happened abroad, the time limit may be shorter. We can advise you on specific regions.

Regardless of the circumstances of your injury, get in touch with us as soon as possible. The earlier you contact us online, the easier it is for us to gather evidence to support your claim.

    • What are interim compensation payments?
    • Where applicable, interim compensation payments cover ongoing costs while you recover from your knee injury, for example, travel expenses to and from hospital. These funds are awarded before your final settlement and will be deducted from your final compensation amount. We’ll let you know if we think you will benefit from interim compensation payments.

    • what if my opponent doesn't accept responsibility?
    • We always try to negotiate an out-of-court settlement for you as this is generally less stressful for all parties, particularly during difficult recovery periods. If your opponent denies responsibility or disagrees with the proposed settlement, we’ll begin court proceedings.

Often, even when trial dates have been set, claims are settled before reaching court. If it does go to court, we’ll guide you through every step.

I was recommended Irwin Mitchell by a solicitor friend of mine and I am very happy to say that the dedication and professionalism shown has completely supported this recommendation.”
