Committed to LGBT+ legal issues

You can’t separate the law from the ongoing struggle for equality that LGBT+ people face. We continue to be a part of this important conversation.

We regularly write and lecture on LGBT+ family law, as well as taking cases to the highest courts in the land.

We’ve helped to shape the law in this area through cases such as Roocroft vs Ball. This landmark case confirmed that same sex couples have the same rights as heterosexual couples when it comes to financial disclosure during divorce/civil partnership dissolution. We also act in landmark public interest cases dealing with once in a generation issues for LGBT+ people.

Our LGBT+ solicitors are friendly and knowledgeable. We’re here with a sympathetic ear, but also with the expertise to make robust legal arguments to protect your interests.

What Services Do We Offer?

Our LGBT+ family lawyers can help you with issues involving:

  • Same sex divorce
  • Civil partnerships
If you’re entering into or dissolving a civil partnership.
  • Unmarried couples
We can help you with cohabitation and prenuptial agreements. We can also help with issues to do with separation (such as making or defending a TOLATA claim, if you’ve lived with your partner in a property that one of you owns).
  • Financial settlements
Whether linked to a divorce, separation or dissolution of a partnership.
  • Children
Legal issues involving your children and forming a family.

Mediation Support Service – 30-Minute Consultation

Family mediation can be a less confrontational and more cost-effective way to resolve a dispute. We offer a 30-minute consultation with one of our solicitors to discuss your situation and if mediation is right for you.

If you decide to go ahead with mediation, you can benefit from our cost effective mediation support service. This service will give you the advice, support and tools to get the best possible outcome – particularly if you’re representing yourself.

Children and Forming A Family

We understand the emotion if you’re facing legal difficulties as a parent, or if you want to start a family. Our family lawyers can help you with legal issues involving:

  • Children from past heterosexual relationships
We can help if you’re facing issues around contact with your children. We often see children being “weaponised” in these cases, where a parent’s sexual orientation or gender identity is used as a basis for withdrawing contact.
  • Children from same sex relationships
We can help if you’re separating in a same sex relationship where you have children. Our services include advice on future child arrangements, relocation of children, or cases where there are concerns for the safety and wellbeing of your children.
  • Adoption and surrogacy
Our lawyers can help you navigate the legal side of adopting a child, or using a surrogate.
  • LGBT+ children
We can help where parents disagree on a way forward regarding their child’s sexual orientation or gender identity.

We’re leading the way in LGBT+ Law

Read more about out landmark Court of Appeal victory for a woman whose ex -partner hid £6m assets in businesses
“Ms Roocroft now has the opportunity to potentially set aside her original settlement and open discussions on a fair settlement based on the true disclosure of the assets built up during the couple’s 18 year relationship.”

Ros Bever

LGBT+ Family Law client

Helen Roocroft discovered that her civil partner, who died intestate in 2013, had hidden assets worth millions of pounds in business assets during the dissolution of their relationship has won a legal battle at the Court of Appeal as she seeks to set aside the original “unfair” settlement.   Specialist family lawyers at Irwin Mitchell acting for Ms Roocroft say the judgment confirms that same-sex couples have the same rights as heterosexual partners under family law and reiterates the message that dishonesty will not be tolerated by the courts.
