Expert Welcomes Negligence Claim Outcome
News that a paratrooper how lost his leg in a landmine explosion is to receive funding for care and support has been welcomed by military claims expert at Irwin Mitchell.
Sergeant Stuart Pearson was successful in his negligence claim against the Ministry of Defence over an incident in Afghanistan in 2006, in which he stepped on a mine while trying to help fellow soldiers.
It was argued in court that his platoon was not given a map highlighting the presence of the minefield, as well as that no appropriate helicopters were initially sent to help them.
Parts of the £1.7 million care package will go towards funding Sergeant Pearson’s need for prosthetic limbs, as well as other aspects of his future care.
Andrew Buckham, who specialises in armed forces accident compensation claims for Irwin Mitchell, said the funding will play a vital part in his future care.
He explained: “This is an example of an injured serviceman justifiably pursuing a civil claim against the MoD and securing the right level of compensation that will provide him with support and financial security for the future.
