Man Wins Battle For Justice
A man left seriously injured when the car he was travelling in was forced into a ditch by a lorry that careered onto the wrong side of the road has today won his battle for justice and secured funding for a life time of care.
Nicholas Butler, 23, from Exeter was just eight when he and his three year old cousin were left seriously injured following the collision in Cadmore End as his aunt took him to school. Sadly his aunt, another cousin and a young friend did not survive the impact.
His lawyers today confirmed that the Judge at the High Court in London had approved a substantial sum, which would provide him with a life time of care and secure ongoing access to rehabilitation.
Colin Ettinger, head of law firm Irwin Mitchell’s serious injury team in London, said: “This collision left Nick with life altering injuries. He suffered a serious brain injury which now means that he is unable to live independently, and will need 24 hour care for the rest of his life. He is also confined to a wheelchair and relies on other people to help him with basic day to day tasks.
“Interim payments helped secure a 24 hour care regime for our client, and have allowed him to purchase and adapt a property and to fund his treatment to date.
“Annual periodical payments have been secured for care and case management. This means the Claimant will receive a significant sum every year to fund continuing care and case management for the rest of his life.
“It is important, however, that the compensation Nick will receive is not seen as a lottery win, and that it will go towards ensuring that he has access to the care and rehabilitation he needs now, and in the future, so that he is able to live as normal a life as possible with the injuries he has sustained.”
His father, Terry Butler said: “It is a huge relief to know that Nick will get the very best care and rehabilitation he needs for the rest of his life. We are pleased that this matter has now come to an end and we are looking forward to moving on with our lives.”
