Compensation For Back Injury At Work
A Rotherham man has received £3,000.00 in an out of Court settlement from his former employers after a faulty chair resulted in him suffering a back injury whilst at work.
Mr Cartwright, 27, of Rawmarsh, Rotherham, suffered the injury whilst working at his desk at Ventura Customer Services based in Manvers Industrial Estate, Wath-Upon-Dearne.
A colleague came over and lent on the back of his chair. However, when the colleague moved away the chair snapped up sharply as the locking mechanism failed causing Mr Cartwright to injure his back.
Mr Cartwright said I was in immediate pain and physically could not move. I did manage to stand up but could not straighten my legs or back.
Mr Cartwright attended hospital where he was informed that he had sustained muscle damage for which he subsequently required physiotherapy.
His payout was secured with the help from Lynne Parker, of personal injury experts, Irwin Mitchell, based at the firms Riverside offices in Sheffield.
Commenting on the payment, Miss Parker said Whilst we use chairs daily, people need to realise the dangers of faulty chairs. The latest ROSPA figures show that over 30,000 people a year injure themselves using chairs highlighting the importance of health and safety procedures.
Employers have a duty of care to their staff, which includes ensuring work equipment is regularly inspected and safe to use. In this case, the chair was clearly faulty. A proper inspection of equipment would have highlighted this, preventing this painful incident occurring.
