Irwin Mitchell has recently acted on behalf of a Birmingham man who has finally won the right for compensation after a long conflict with insurers.
The man from Birmingham sustained a spinal cord injury in a road accident, while he had been travelling in a car with a family member, when it went out of control, striking parked vehicles before overturning.
The man sustained injuries to his cervical spine, with loss of sensation and impaired movement.
The insurance company that insured the vehicle in which the man was a passenger had argued that they were not obliged to compensate the man even though he was not to blame for the accident.
The matter had been listed for trial at the Birmingham High Court, which would have dealt with this preliminary issue. However, shortly before the trial, the insurers conceded that they were obliged to compensate our client.
Stephen Nye, Partner in our Serious Injury team in Birmingham dealt with the matter and commented: "Whilst we are delighted that our clients right to compensation has now been established, it is frustrating that the insurers pursued this argument for so long, when in reality they had no evidence to support their position. He is greatly relieved that we have been able to resolve this matter and is re-assured in the knowledge that in due course he will have sufficient funds to meet his complex and lifelong care needs and to provide therapies, wheelchair equipment and appropriate housing.
"The value of the compensation will be assessed in due course, but we have now been able to secure substantial interim funds, to ensure his immediate needs are met".
