Our Public Liability team recently settled a dog bite claim for a man from Chesterfield who sustained injuries after he was bitten by a dog.
As our client was walking his dog, the defendant’s dog ran across the street from its home towards him. The defendant’s dog bit our client on his right arm above the elbow and then also attacked our client’s dog who, later had to be put down as a result of the injuries it sustained.
Our client, who was 55, sustained severe dog bites to his upper right arm which, resulted him having to undergo surgery. He was left with severe scarring and loss of muscle strength to his arm.
It was alleged that the dog’s owners, knowing the dog to be of a vicious and aggressive nature, failed to ensure that it was secured correctly within the confines of their property. It was also alleged that they failed to ensure that the dog was kept on a lead and muzzled in public and failed to prevent the dog from attacking our client.
The dog’s owners denied liability for the incident. However, a settlement was eventually reached shortly before trial with out client accepting 50% responsibility for the accident and compensation of £3,500.
