    • How Much Compensation Will I Receive?
    • The amount of compensation you can claim depends on the kind of injuries you’ve suffered and how they’ve affected you.

      The more serious and far-reaching your injuries, the more compensation you will need to pay for things like adaptations to the home, medical bills and loss of earnings.

      Broadly speaking, personal injury compensation is broken down into two parts: general damages and special damages.

      General Damages

      This is money that you receive for what the law calls “pain, suffering and loss of amenity.” This amount is calculated using recognised guidelines and by looking at what others have received in similar cases.

      Special Damages

      This includes compensation for your lost earnings and any wages you might lose out on in the future (if you can’t return to work or the same position). This type of damages is designed to repay any expenses you’ve incurred such as transport to hospital and any equipment you’ve had to purchase to make life easier.

    • How Long Do I Have To Make A Claim?
    • Normally, you have three years from the date of an accident to start a claim for compensation. For children, the three year time limit begins on their 18th birthday.

      There’s no time limit for people who don’t have the mental capacity to make legal decisions – this often applies to those who have suffered serious brain injuries.

      In fatal cases, the family of the person who died have three years to make a claim, starting from the date they died or from when they found out the results of a post-mortem.

      If you were injured in a criminal attack or assault, applications to the Criminal Injuries Compensation Scheme need to be made within two years of the incident. We’ve helped many people to claim under this scheme, so call us and we will talk you through your options.

    • How Will My Claim For Compensation Work?
    • The process for claiming compensation varies from case to case, but we’re proud of our ability to take on more complex claims.  

      Firstly, we’ll need to decide if your claim has a reasonable chance of success.  We offer a free initial consultation where we can advise you further and we’ll often be able to offer help, even if your case has been turned away by other solicitors.

      Once we’ve taken your case on, we’ll work out who was to blame for your accident (known as liability). Sometimes more than one person or organisation might be responsible for the injury – but we’ll work hard to establish the facts around the reason for your injuries and find those who are responsible.

      We investigate accidents using our team of experts, employing external personnel when needed to prepare reports. For example, in the case of a road accident we might get a report of the incident from our own accident reconstruction expert.

      In terms of your recovery from injury, we can help you access rehabilitation services and private medical care. We’ll arrange for an independent medical professional to assess your injuries and diagnose any treatment or care that you need, which will help us come up with the compensation figure that’s right for you.

      You may also need early compensation payments (or ‘interim’ payments) to be made to help pay for things like travel to and from medical appointments. We may be able to secure these for you while your claim is ongoing, so you won’t lose out financially.

      After we’ve finalised all the evidence, we may meet face-to-face with the insurers to talk about settling your case. Often this can be done out of court, providing the responsible party admits they are to blame, and that we can agree on the compensation. 

      If we can’t agree, your case may go to court for a judge to decide. If you do have to go to court, it’s nothing to worry about. We have years of experience of court proceedings and we’ll stand by you every step of the way. However, even if your case does go to court, many serious injury claims are still settled before the trial date.

    • A No Win No Fee agreement means that you don’t have to pay any upfront fees when you make a personal injury claim.*
