An 85 year old West Midlands man who suffered horrendous injuries to his leg in a road accident has successfully sued the driver responsible.
The injured man was represented by Stephen Nye of Irwin Mitchell's Birmingham office. Stephen commented: "My client's leg was crushed underneath a lorry when he was crossing at a pedestrian crossing. Unfortunately the leg was so badly damaged that it had to be amputated above the knee.
"Liability was denied by the driver throughout and because of this Court proceedings were issued. My client, whilst having health problems, had enjoyed an independent and full life prior to the accident and this was severely affected by his injuries. His damages award of £220,000 provides him with a secure future and will pay for the additional care needs he has by reason of his injuries. The accident could easily have been avoided if the driver had been paying greater attention and if the lorry had been fitted with a forward facing mirror which would have allowed the driver to check his blind spot".
