The family of a former asbestos insulation worker, Mr H, has received substantial compensation from the insurers for his former employer, Thompson Insulation Services Ltd.
Mr H worked as an apprentice lagger, also known as an ‘improver’ at Thompson Insulation Services from 1961. He subsequently completed his apprenticeship and continued to work as a lagger for the company. Thompson Insulation Services employed Mr H to work on their maintenance contract at the Austin Motors site at Longbridge for the majority of his employment.
Mr H was exposed to asbestos throughout his employment when mixing asbestos powder with water to form lagging and, later, loading blue asbestos into spray flock asbestos machines. Mr H was never warned about the dangers of working with asbestos and it was not until in the 1970s that he was provided with any protective equipment.
In August 2006 Mr H suffered with sudden onset of pain and for the next 9 months suffered horrendously during his illness. Mr H had developed mesothelioma of his peritoneum which is a particularly painful form of the disease. As well as suffering with significant pain, he also suffered from fluid in his abdomen, bed sores, constipation and vomiting. He passed away in May 2007.
A settlement has now been reached with Zurich Insurance, the insurers for Thompson Installation Services. Mr H’s widow has been awarded in excess of £150,000.00 in compensation.
Iain Shoolbred, a Solicitor from Irwin Mitchell’s specialist asbestos related disease team, who handled Mr H’s case, said “I am very pleased that Mr H’s case has been concluded on such positive terms for his family. Mr H was heavily and avoidably exposed to asbestos throughout the 1960s and the 1970s when working for Thompson Installation Services. Mr H underwent a terrible ordeal as a result of is illness and it is only now that the insurers have decided to settle this case that his family can start to put this behind them.”
