Asbestosis, an illness characterised by scarring of the lungs by asbestos fibres, can have life-changing effects. Many people develop the illness because they were exposed to asbestos at work, particularly in the building industry, shipyard workers and those who work with insulation.

We’ll start investigating your case as soon as possible, finding out where you could have been exposed to asbestos, even if you’re unsure. Due to the nature of asbestos related diseases, it’s likely that your exposure happened decades ago: however, our specialist team are experts in determining where you were exposed, no matter how long ago it was. Our investigations will also help us calculate how much compensation we feel you are likely to receive.

Using this evidence, we’ll be able to determine who was at fault for your exposure and will contact the company and/or their insurer.

If they accept that they’re responsible for your exposure and subsequent illness, we could help you obtain early interim payments. These can support you financially and can help to pay for any medical care you might need while your claim is on-going.

You may be able to make a claim even if your former employer is no longer trading. Our lawyers can access several databases so we’ll be able to trace the company and can check whether it’s currently trading under a different name.

If your employer is no longer trading, don’t worry: compensation is normally paid by your former employer’s insurer. Even if you were exposed to asbestos decades ago, we can still help you find out who was responsible so that you can access the compensation you deserve.

You’ll normally have three years to make a claim from the date you were diagnosed with asbestos related disease. If you want to claim on behalf of a loved one who has sadly died because of lung cancer, you’ll have three years to make a claim from the date of the death or from the point where a post-mortem revealed asbestos exposure as the cause of death.

What Regulations Should Have Been Followed To Prevent Asbestos Exposure?

Even though asbestos is currently banned in the UK, it’s still important that precautions are taken to limit your risk of exposure to asbestos already in situ. Regulations were introduced in 1970 to provide guidance on the use of asbestos in the workplace.

A number of different forms of asbestos have been banned since 1970, the last being restricted in 1999. Because of this, it’s possible that you could have been exposed to asbestos if you’ve worked in buildings that were built or refurbished before the year 2000.

If your role at work means you could be exposed to asbestos, your employer must follow strict rules set out by the Health and Safety Executive (HSE). Employers, managers and traders should:

  • Identify if asbestos is present and what type it is
  • Carry out a risk assessment to see whether it’s possible to do the work without asbestos exposure
  • Consider whether the work should be done by a contractor who holds a specialist license to handle asbestos
  • Notify the relevant authority (if needed) to let them know about the work which will involve asbestos exposure
  • Provide training and protective equipment to employees

What Are The Symptoms Of Asbestosis?

Asbestosis is caused by breathing in asbestos fibres, which results in scarring to your lungs. Most asbestosis cases are caused by asbestos exposure many years before, so it’s essential that you visit your doctor if you’ve been experiencing:

How Will Asbestosis Affect Me In The Future?

Sadly there's no cure for asbestosis once it has developed, as the damage to your lungs can't be reversed. This fact will be considered when we calculate how much compensation you should receive.

Asbestosis can get worse over time and also means that you have an increased risk of developing illnesses such as lung cancer, mesothelioma and pleural disease. The condition sometimes has a significant impact on your day-to-day health due to breathing issues and can even shorten your life expectancy.
