Anyone who has had their rights infringed or has been treated unfairly by a public body can make a claim. You can also claim on behalf of people who are unable to make decisions for themselves, such as adults with certain mental illnesses or brain injuries, or children.

Judicial Review is a way to challenge public bodies if you think they have made a decision that is unfair, unlawful or irrational. You can only apply for judicial review once you have exhausted all other options through complaining and using any relevant appeals procedure.

If your claim is successful, a judge can force an organisation to make its decision again, prohibit the organisation from doing certain things or force it to comply with its legal duties. In some cases they even award you compensation.

Trial Collapses After Police Lose Evidence

Compensation Recovered After Human Rights Act breach

We helped a woman get compensation after police lost vital video evidence relating to her case, causing her trial to collapse. 

Our client came to the police after leaving an abusive relationship. She gave a video statement as evidence, but when this was lost she had to do another one a few months later. 

The Crown Prosecution Service decided that the case should not go to trial because of differences in the two statements and the woman lost her chance of justice.

What Is The Human Rights Act?

The Human Rights Act 1998 defends the basic rights of individuals, irrespective of age, gender, ethnicity and income. If you believe these rights have been breached, it allows you to have your case heard in a UK court rather than having to go to the European Court of Human Rights in Strasbourg.
