While walking in Lingfield, Surrey, our client fell after tripping on the roots of a tree that were protruding through the pavement.
The roots of a tree that was growing through the pathway had pushed up through the tarmac, causing the path to become uneven and dangerous to walk on.
As a result of the fall our client suffered headaches, facial scarring and damage to several front teeth.
Although liability was initially denied by the local authority and proceedings were issued, they later agreed to pay our client £12,500 in compensation a few weeks before the trial.
