Our client sadly developed mesothelioma aged 58. His only known asbestos exposure was during a short period of employment with William Moss & Son Ltd, now William Moss Group Ltd, based in Loughborough, in about 1965.
He was employed as a labourer/scaffolder and he assisted on the construction of an Olympic sized training swimming pool in Leicester. He came into contact with asbestos dust from boilers which were insulated with asbestos lagging.
We were successful in recovering the architect's plans and specifications for the construction of the swimming pool (from Leicester City Council’s Planning Department) and the plans also confirmed the application of sprayed asbestos to the ceiling void of the swimming pool.
Court proceedings were commenced and after disclosure of our documentary and lay witness evidence the insurers and solicitors acting for William Moss Group Ltd conceded that our client's employers had been negligent. Our client subsequently received an interim compensation payment.
The claim was concluded shortly before trial in a 6-figure compensation sum which reflected our client's future earning potential, including working beyond age 65.
