A Midlands man received a £62,500 out of Court settlement as a result of a tripping accident whilst visiting his local Indian takeaway.
The 47-year-old man tripped and fell due to the presence of a low unmarked and unlit wall in February 2007. He successfully pursued a claim against the private owners of the restaurant for the accident which occurred in their car park.
He sustained a fractured left knee which required surgical intervention and insertion of metal work.
His claim was settled in November 2008 by Toni Long of Irwin Mitchell's specialist Fast Track Personal Injury Team based in Birmingham.
Toni Long said: "The presence of the low unlit wall clearly presented a tripping hazard to customers and members of the public visiting the neighbouring shops. Simple measures, such as the provision of adequate lighting, could have prevented this accident.
"Unfortunately, as a result of this breach of duty of care, my client sustained a nasty knee injury and has been told that there is a strong chance that he will develop osteoarthritis within 5 - 10 years of the accident date".
